These Terms of Service (“Terms”) apply to all services provided by nothing but the grain (“nbtg.dev”, “we”, “us”, or “our”), established in the Netherlands, through https://www.nbtg.dev (the “Website”).
By submitting film to us or using our services, you agree to these Terms.
1. Services
nbtg.dev provides photographic film development, scanning, photographic chemistry and related services (“Services”).
Services are provided on a best-effort, professional basis using industry-standard equipment and processes. Results may vary depending on film condition, age, exposure, and handling prior to submission.
2. Customer Responsibilities
You confirm that:
- You are the lawful owner of the film or are authorised by the rights holder to submit it;
- The content of submitted film does not violate applicable law;
- You have retained copies or accept the inherent risks associated with physical media.
You are responsible for packaging and shipping film to us securely.
3. Image Ownership and Licence
All photographic images, negatives, slides, and scans submitted to or produced by nbtg.dev remain the exclusive property of the customer or original rights holder.
By submitting film for processing or scanning, you grant nbtg.dev limited, non-exclusive, temporary licence to:
- Handle and develop film
- Digitise negatives or slides
- View images
- Perform technical and visual adjustments (including exposure correction, colour balancing, contrast adjustment, cropping, and dust removal)
This licence exists solely for the purpose of providing the requested Services.
We do not acquire any ownership rights in your images.
A NDA can be signed upon request, please contact us in advance of film delivery with the required documents.
4. Use of Images
nbtg.dev will not:
- Use images for marketing or promotion
- Publish images publicly
- Share images with third parties
- Retain images beyond the service period
unless you have provided explicit prior consent.
5. Storage, Retention, and Destruction
Customers are responsible for downloading and backing up delivered scans.
- Physical film is retained only for the period necessary to complete the Services and return it to you, unless you explicitly request destruction.
- Customers may choose, at the time of submission, to have their negatives destroyed after processing. nbtg.dev will comply with this request, and destruction is irreversible.
- Digital scans are stored temporarily for delivery and short-term quality control, then deleted after a reasonable operational period, unless otherwise agreed.
- Customers are responsible for downloading and backing up delivered scans.
By requesting destruction of physical negatives, you acknowledge that nbtg.dev assumes no responsibility for loss of originals and that this action is final and irreversible.
6. Digital Delivery
Digital scans are delivered via secure third-party file transfer services. We are not responsible for:
- Delivery failures caused by incorrect contact details
- Customer failure to download files before expiration
- Security of files after successful delivery
7. Pricing and Payment
Prices are as stated on the Website or agreed in advance.
Payment is required before or upon completion of Services, unless otherwise agreed. All listed prices are inclusive of applicable taxes unless stated otherwise.
8. Liability
To the maximum extent permitted by law:
- We are not liable for loss, damage, or deterioration of film caused by factors beyond reasonable control, including latent defects, age, or prior handling
- Our total liability for any claim related to Services is limited to the amount paid for the affected service
- We are not liable for indirect or consequential damages, including emotional distress or loss of commercial value
Nothing in these Terms excludes liability that cannot be excluded under Dutch law.
9. Unlawful or Prohibited Content
We reserve the right to refuse Services if submitted material appears to involve unlawful content. We are not obligated to process or return such material where prohibited by law.
10. Privacy
Personal data is processed in accordance with our Privacy Policy, which forms part of these Terms.
11. Changes to These Terms
We may update these Terms from time to time. The latest version will always be available on the Website.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent courts of the Netherlands.
